Enhanced Liability Coverage Now in Effect

PARSAC coverage compares favorably to other pools but the Board felt that some enhancements could be made to further protect the members' interests. After careful consideration, the Board approved the following revisions, which became effective upon adoption on December 4, 2014:
  • Inverse Condemnation: Excluded for except for physical damage to tangible property, which is subject to a sublimit per occurrence. This sublimit has been increased from $250,000 to $500,000 (Exclusion P, page 11).
  • Compliance with Americans with Disabilities Act: Coverage for defense costs and damages have been provided since 06-07 with a sublimit of $250,000. This sublimit has been removed entirely; however, the cost of ADA remediation remains excluded (Exclusion CC, page 13).
  • Definition of Occurrence: PARSAC coverage is based on when a covered event began; however, CSAC, our excess liability pool, bases coverage on when an event ends. For claims that occur over multiple years, this difference could result in no excess coverage being available. Section IV now allows the Board to determine the coverage period in its sole discretion (Coverage Period, page 8).
A nominal amount of funding was required to implement these coverage enhancements, which was off-set by using a portion of the excess liability dividend.
