It has been more than 100 years since the Supreme Court last heard a case on design patents. The nature and uses for these patents has changed drastically since then. We believe it is high time that the Court bring clarity to design patent litigation and damages. The outcome of the Apple v. Samsung case stands to carry lasting effects on not only design patents, but on the broader technology industry and innovation.
