Before we all head off for a well-deserved Thanksgiving rest, we want to share a few more thoughts for 2023.
Our last two messages have focused on pay transparency and all that means, because that seems like the biggest news in quite a while. But there are a few other changes coming and we don’t want you to miss those.
Minimum wage and salary
First, California’s minimum wage will increase to $15.50 per hour for all employers on January 1, 2023. For employers with less than 26 employees, that's a big jump. Don't forget to check the minimum wage in the employee's work location because you must pay the higher wage.
The increase also means that the minimum salary for most exempt employees will increase to $64,480 per year, with an important exception for Computer Software Professionals at $112,065.20 per year ($53.80 per hour). Although many cities have higher minimum hourly wage rates, the minimum exempt salary is based on the state minimum wage. What is a designated person?
A designated person is someone who an employee has a family-like relationship with. It’s that chosen or unofficial family that brings so much to our lives and who we want to be there for. Why does it matter? Under both the CFRA and the California sick leave law, employees may designate a person who will be treated as a family member under these laws. The designation does not need to be in advance, and employers can limit it to once every 12 months. There are other nuances and restrictions, so don’t hesitate to ask us to help.
Expanded bereavement leave
Employees with at least 30 days of service are eligible for five days of unpaid bereavement leave upon the death of a family member. If you already offer some paid bereavement leave, you can comply with the law by adding unpaid days. Make sure that your managers are aware of the change and talk to your Affogato consultant about updating your handbook policy if necessary.

And finally, it looks like California’s COVID Emergency Temporary Standard (ETS) will be coming to an end on December 31, 2022. If anything changes, we’ll let you know.
