Addressing the Acceptable Separation Distance for Residential Propane Tanks Final Rule in HEROS

HUD has revised regulations at Part 51 to exempt liquified petroleum gas or propane containers up to 1,000 gallons that comply with industry standard, National Fire Protection Association (NFPA) Code 58. This change went into effect on February 24, 2020. Please refer to the FAQ below to address this change in the HUD Environmental Review Online System (HEROS).

How should tanks exempted from coverage under 24 CFR 51C by HUD’s January 24, 2020 final rule Conforming the Acceptable Separation Distance (ASD) Standards for Residential Propane Tanks to Industry Standards be addressed in HEROS?

HUD is currently updating the Explosive and Flammable Hazards screen in HEROS based on this rule. In the interim, please incorporate the new LPG/propane exception in your HEROS analysis as follows:

The HEROS Explosive and Flammable Hazards screen, Question 3, asks whether there are any current or planned stationary aboveground storage containers of flammable or explosive materials within 1 mile of the proposed HUD-assisted project site. If there are:

  • No containers of flammable or hazardous materials within the 1-mile search distance OR
  • ONLY LPG/propane tanks with a water volume capacity of 1,000 gallons or less that are in compliance with the 2017 or later version of NFPA 58,

answer “NO” to this question and attach documentation of NFPA 58 (2017) compliance to the screen.
