HUD Issues DRGR Guidance (for Public Law 113-2 Grants Only)

HUD has issued new DRGR guidance for grantees receiving funds under the Disaster Relief Appropriations Act of 2013 (P.L. 113-2). Grantees under P.L. 113-2 must now adhere to the following requirements:

DRGR Guidance on Reporting Elevated Structures

Overview and Purpose: The April 19, 2013 Federal Register Notice requires grantees under P.L. 113-2 to elevate (or flood-proof) new construction and substantially improved structures that lie within a Special Floodplain Hazard Area or 100-year Floodplain, one foot higher than the latest FEMA issued base flood elevation (BFE). HUD has created a new performance measure in DRGR to allow grantees to report the implementation of this requirement. Grantees must now select the “# of Elevated Structures” for all applicable activities. All structures reported as being substantially rehabilitated (in addition to new construction reported in the system) must comply with the elevation/flood-proof requirement.

Action Item: For all grantees receiving funds under P.L. 113-2, select the “# of Elevated Structures” performance measure in the DRGR Action Plan and enter the projected number of structures for each applicable activity.

DRGR Guidance on Rental Assistance Activity Type

Overview and Purpose: Following several recent disasters, the Department has waived section 105(a) of the Housing and Community Development Act, to make eligible long term rental assistance and utility payments on behalf of homeless and at-risk households. HUD has added a new “Rental Assistance (waiver only)” activity type in DRGR to allow grantees to report the implementation of a long term rental assistance program. Grantees must now select the “Rental Assistance (waiver only)” in the DRGR Action Plan for this program and report on # households assisted.

Action Item: For all grantees receiving funds under P.L. 113-2 that have received a waiver of section 105(a) of the HCD Act to make eligible long term rental assistance, select the “Rental Assistance (waiver only)” activity type in the DRGR Action Plan for this program.

Reporting Reminder - # of Substantially Rehabilitated Units

As previously instructed in guidance delivered in November 2013, all grantees under P.L. 113-2 are required to comply with new green build certification requirements for residential units being substantially rehabilitated or created. In order to track this, grantees must select the “# of Substantially Rehabilitated Units” performance measure in the DRGR Action Plan and enter the projected number of units for each applicable activity.
