Release of the Notice on Appeals for the FY2012 Continuum of Care (CoC) Program Competition
The Notice on Appeals for the FY2012 CoC Program Competition is now posted on the HUD HRE.
 
It should be noted that applicants requesting an appeal using this Notice are required to submit all information to support the appeals request after the close of the FY2012 CoC Program Competition at 7:59:59 PM today, Friday, January 18, 2013. For applicants that either fall under category 1 or 3 below, information submitted through this Notice is the last stage of completing the appeal request. The first stage was the completion and submission of the project application in e-snaps by the deadline mentioned above.   
 
This Notice provides guidance to CoCs and Project Applicants applying for funding through the FY 2012 CoC Program Competition regarding the information that must be submitted to HUD in order to appeal one of the following decisions: 
  1. Project applicant believes that it was denied the right to participate in the CoC planning process in a reasonable manner. These applicants must have submitted a project application to HUD with a written notice of intent to appeal attached to its project application in e-snaps as a solo applicant and met the 7:59:59 PM (ET), January 18, 2013, application deadline for the competition. For more information see Section II.A of the Notice. 
     
  2. Applicant was denied CoC Program funds by HUD, or requested more funds than HUD awarded. Eligible applicants that submitted an application to HUD, or that requested more funds than HUD awarded, may appeal HUD’s decision. For more information see Section II.B of the Notice.
     
  3. Eligible applicant whose jurisdiction refused to sign the Consolidated Plan certification for the project. These applicants must have submitted a project application in e-snaps as a solo applicant and met the 7:59:59 PM (ET), January 18, 2013, application deadline for the competition with a written appeal attached to its project application.
HUD strongly encourages applicants that believe they fall under one of the above categories to read the Notice in its entirety, provide evidence that supports the appeal request, and clearly state the applicant’s claim in a timely manner based on the deadlines highlighted in the Notice.
