List 3 - Section 301 China Origin Product Exclusion Process Released

Dear Valued Customer,
The United States Trade Representative (USTR) has created a new portal and posted a Federal Register publication with guidelines for submitting Section 301 exclusion requests. Section 301 exclusion requests may be submitted by the trade pertaining to List 3 import products of China origin with increased tariffs worth $200 billion. The List 3 increased tariffs took effect September 6, 2018 initially at 10% and were subsequently increased to 25%. The process and method of submitting exclusions has been modified from the previous versions. Additional instructions are provided within the publication highlighting the required data (*) to be submitted and whether the data will be public (Public) or designated business confidential (BCI).
Important dates and process for submitting exclusion requests:
Exclusion requests are currently being accepted.
The deadline for filing product exclusion request is September 30, 2019.
All parties submitting an exclusion request must register to use the new portal.
Exclusion requests will now be posted to the USTR Tariff Portal for public comment and viewing by the Trade.
Once the exclusion request is posted, interested persons will have 14 days to comment.
The original requestors will have 7 days to post a reply to responses received for their exclusion request.
Granted exclusions will be effective for one year and will be retroactive to September 24, 2018.
The USTR has provided an FAQ on the overall process, and we have included the original FRN announcements with the products subject to the increased tariffs for List 3: 83 FR 47974 and 83 FR 49153.
