Niger’s Property Attached in the US in Satisfaction of an Award Confirmed by the CCJA

As previously reported,[1] in 2014, a sole arbitrator issued a USD 28 million award against Niger in favor of Africard, in a dispute over a contract for the production of electronic and biometric passports.  This award was later upheld by the OHADA Common Court of Justice and Arbitration (“CCJA”). The French Cour de Cassation Orders Getma to Cover Guinea’s Unpaid Portion of Arbitrators’ Fees

In a new episode of the now infamous Getma case, the French Cour de Cassation rendered a decision about the arbitrators’ request to have Getma pay the portion of the arbitrators’ fees that Guinea had refused to pay, amounting to USD 450,000. Read more.


LCIA Tribunal Rejects Djibouti’s Bribery Claim in Port Concession Dispute

In 2014, Djibouti initiated an LCIA arbitration against DP World, a Dubai company, which operated a container terminal in the port of Djibouti.  Djibouti claimed that investigations by its anti-corruption agency had revealed that DP World had paid bribes in order to obtain the concession. Djibouti rescinded the concession but allowed DP World to continue its operations in the terminal during the arbitration. Read more
