General Regulatory Information
✓ DDTC Amends ITAR to Clarify Provisions re: Public Disclosures, Debarments
The Directorate of Defense Trade Controls (DDTC) amended the ITAR to clarify recent revisions made pursuant to the Export Control Reform (ECR) Initiative.  Specifically, the final rule (with request for comments) clarified two things: (1) when DDTC will withhold from public disclosure certain information included in license applications, and (2) the policies and procedures regarding statutory debarments.  The rule also corrected certain administrative and typographical errors.
✓ President Issues Proclamation Modifying HTSUS
President Obama issued Proclamation 9549 modifying the Harmonized Tariff Schedule of the United States (HTSUS) to conform the HTSUS to amendments made to the International Convention on the Harmonized Commodity Description and Coding Systems and its Protocol by the World Customs Organization.
✓ OFAC Publishes Kingpin Act/Honduras-Related General License
The Office of Foreign Assets Control (OFAC) published General License 1C authorizing certain transactions and activities (that would otherwise be prohibited by the Kingpin Act) to liquidate and wind down Banco Continental, S.A., a Honduran bank identified on OFAC’s SDN List.  The authorization expires June 14, 2017, unless extended or revoked.
✓ U.S. International Trade Deficit Increased in Oct. 2016
The U.S. Census Bureau announced that the nation’s international trade deficit in goods and services increased from $36.2 billion in September to $42.6 billion in October.  As exports decreased, imports increased, climbing from $225.9 billion in September to $229 billion in October.
✓ OFAC Updates SDN List
OFAC updated the SDN List with Counter Terrorism Designations.
ACE and Automated Systems
✓ FDA Publishes ACE-Related Final Rule
U.S Customs and Border Protection (CBP) announced that the Food and Drug Administration (FDA) published a final rule regarding requirements for the submission of information to ACE.  CBP stated that it “is now mandated that select data elements be submitted into ACE at the time of entry for FDA-regulated articles to include foods, human and animal drugs, medical devices, biological products, human cells, tissues, and cellular and tissue-based products (HCT/Ps), radiation-emitting electronic products, cosmetics, and tobacco products.”
✓ CBP Issues Guidance to Correct EEI Filing Issue in AESDirect
CBP announced that it identified an issue with the Electronic Export Information (EEI) filing printout in AESDirect and provided guidance to help resolve it. 
✓ DDTC Publishes Implementation Guide
CBP announced that DDTC has posted an updated PGA Message Set Implementation Guide V1.6, which can be accessed here.  CBP stated that the updated guide includes administrative changes to sample message layouts.

✓ Upcoming FDA Guide 2.5 Webinar
CBP announced that it, together with the FDA, will host a webinar on Tuesday, Dec. 13, 2016 at 2:30 p.m. (ET).  The purpose of the webinar is to review updates to FDA’s Supplemental Guidance for ACE Version 2.5 and the related PGA Samples.  (Please click here for webinar access information.)
